This DMCA / Copyright Policy explains how we handle claims of copyright infringement on our platform, https://www.subixo.com (the "Site"), in accordance with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.

We act as an online service provider and qualify for the safe harbor provisions under the DMCA. We do not actively monitor user-uploaded content for infringement but will expeditiously remove or disable access to material upon receiving a valid DMCA notice.

Reporting Copyright Infringement (DMCA Takedown Notice)

If you believe that any content on Subixo infringes your copyright, please submit a written DMCA takedown notice to our designated Copyright Agent. Your notice must include all of the following elements to be valid under the DMCA:

1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

2. Identification of the copyrighted work claimed to have been infringed (or, if multiple works, a representative list).

3. Identification of the infringing material (provide the exact URL(s) or product ID(s) where the material is located on our Site).

4. Your contact information: address, telephone number, and email address.

5. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Upon receiving a valid notice, we will:

- Remove or disable access to the allegedly infringing material.

- Notify the user who uploaded the content (if possible).

- Take appropriate action against repeat infringers, up to and including account termination.

Counter-Notice (If Your Content Was Removed)

If your content was removed or disabled in response to a DMCA notice and you believe it was removed by mistake or misidentification, you may submit a counter-notice to our Copyright Agent. The counter-notice must include:

1. Your physical or electronic signature.

2. Identification of the material that was removed or disabled and its location before removal.

3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of a mistake or misidentification.

4. Your name, address, telephone number, and email address.

5. A statement that you consent to the jurisdiction of the federal district court in New Delhi, India (or the applicable jurisdiction), and that you will accept service of process from the person who provided the original notice.

Upon receiving a valid counter-notice, we may forward it to the original complainant. If we do not receive a court order or other legal notification within 10-14 business days, we may restore the material.

Repeat Infringers

We reserve the right, in our sole discretion, to terminate or disable access to accounts of users who are repeat infringers of copyright (as determined by multiple valid DMCA notices).

Misrepresentation

Submitting a false or misleading DMCA notice or counter-notice may result in legal liability (including damages and attorney's fees under 17 U.S.C. § 512(f)). Please ensure your claims are accurate.

- This policy applies only to copyright claims under DMCA. For other IP issues (trademarks, etc.), contact us separately.
